On October 1st, the same day that Bush activated the 1st Brigade domestically, the Office of the Secretary of the Department of Health and Human Services released a disturbing “Declaration Under the Public Readiness and Emergency Preparedness Act”:

protections for anthrax countermeasures based on a credible risk that
the threat of exposure to Bacillus anthracis and the resulting disease
constitutes a public health emergency.

Support for this idea comes from a government program just announced to distribute Anthrax vaccine to 100% of the population in certain areas using United States Postal Workers.
Mail Carriers Can Have Antibiotics for Anthrax Plan
“If there ever is another anthrax attack, the letter carrier may deliver your antibiotics. Federal health officials are beginning a project in Minneapolis-St. Paul to let letter carriers stockpile a personal supply of emergency antibiotics so they are protected and ready to deliver aid to the rest of the city at a moment’s notice.
These letter carriers are being asked to put their lives on the line to help their communities,” Health and Human Services Secretary Michael Leavitt said Wednesday. By ensuring they are protected first, “the carriers can be ready on short notice to take to the streets.”
The project aims to overcome a big hurdle of emergency planning. The government has much drugs stockpiled in case of future bioterrorism, but few ways to get them quickly to panicked citizens. Leavitt noted that if someone possibly has inhaled anthrax, the chances of survival are best if antibiotic treatment begins within 48 hours.
The U.S. Postal Service came forward, he said. “They have people who every day walk to every house.”
Those carriers could provide “a front-end quick strike,” added William Raub, Leavitt’s senior science counselor.
But could letter carriers successfully deliver medications to a great number of homes during an emergency, when the carriers might be mobbed? Would they be willing?
To address the first issue, test projects in Seattle, Philadelphia and Boston over the past two years paired letter carriers with police officers on holidays. Carriers volunteered to do double routes, delivering empty pill bottles along with a “This is a Test” flier explaining what was happening. In Philadelphia, 50 carriers reached about 53,000 households in eight hours, Raub said.”
“An emergency drill, complete with employee evacuations, is planned this afternoon at the county’s main post office in Carmel Mountain, postal officials said.
The U.S. Postal Service plans to tests its anthrax-detection systems, removal and decontamination procedures.
The drill is set for 4 p.m. at the Margaret Sellers Processing and Distribution Center on Rancho Carmel Drive. A detailed plan for response to an anthrax attack can be found in the government.”
“Government mail carriers will deliver emergency supplies of antibiotics to people in U.S. cities after an anthrax attack, U.S. Department of Health and Human Services officials said on Wednesday.
The system has been tested in three large cities — Seattle, Philadelphia and Boston — and a pilot program is set to begin soon in the Minneapolis-St. Paul area in Minnesota.”
If you are hurt by taking an anthrax vaccine, you cannot sue the manufacturer.
In this example a Michigan company, BioPort, has been awarded a no bid (“sole source”) contract by the Department of Health and Human Services to produce 5 million doses of the BioThrax anthrax vaccine for a total price of $122 million. Payment for the contract is made through the Centers for Disease Control and Prevention in Atlanta, GA. Delivery of the 5 million anthrax vaccine doses was to be completed by May 2007.
The contact includes complete indemnification against “hazardous risks” which includes any environmental damage or human exposure to infectious or toxic materials during the manufacturing of the vaccines, ANY adverse reaction (including death) by those taking the vaccine. BioPort is also indemnified if the product fails to perform at all! In short, the manufacturer is indemnified if their product does no good whatsoever and kills everyone that is injected!
This is just one of 22 contracts for a variety of anthrax vaccines, as well as other antibiotics effect in preventing or treating anthrax including doxycycline, cipro, amoxicillin, rifampin, Clindamycin, and many others.
Indemnification means that the government is promising to defend the contractor if they are sued and to agrees to pay their legal expenses. Of course this potentially exposes the government to huge legal fees if law suits for a dangerous vaccine were brought to court.
THIS is the reason for the declaration referenced above, because the declaration referenced above goes beyond indemnification to grant complete immunity or “liability protection”. This eliminates any legal expenses because now no one will be able to sue manufacturer or the government for damage occurring from the administration of anthrax vaccines!! This declaration relieves the government and its contractors of any responsibility for harm caused by administering anthrax vaccines to the public.
Does the introduction of this declaration of “targeted liability protection” mean that an anthrax attack is imminent? Not necessarily. For example a very similar targeted liability protection was declared for the manufacturers of the Avian Flu vaccine back in January 2007. You can read about it here.
The move to protect vaccine manufacturers from any liability first last surfaced during the 2005 pandemic flu scare when the country was faced with a shortage of flu vaccine. The Bush administration used the flu vaccine shortage as an opportunity to press for immunity for all vaccine manufacturers.
What is the purpose of this notice? It provides legal immunity for contractors who are manufacturing anthrax vaccines.
“Fear of lawsuits, hostility toward trial lawyers, short-sightedness and pandering to special interests are behind a Republican-led effort to enact quickly unprecedented vaccine liability protection for drug manufacturers and sellers with little or no compensation for injured victims in the event of a pandemic flu outbreak, say a host of health, consumer, union and other groups.
Many of those groups have joined together in an effort to force into the open what have been closed-door negotiations by Senate and House Republicans over a plan to attach the liability waiver to a pending Department of Defense appropriations bill expected to pass both chambers before the year’s end.”
This is also reminiscent of Bush’s obsession to provide telecom companies legal retro-active immunity as they assisted the President in treasonously spying on Americans.
The burning question remains: Why now?
The anthrax vaccines have already been manufactured. So why is the government suddenly so interested in protecting itself from the costs of indemnifying the vaccine manufacturers? Could it be that they have reason to believe that an anthrax attack is imminent?
This report goes on to say …
“Last week, Emergent won a second order from HHS of 14.5 million doses of Biothrax worth as much as $404 million. The government’s first order of 19.75 million doses of Biothrax is currently being filled and should earn Emergent $448 million.”
Folks that’s almost one billion dollars to a single contractor for 35 million doses of anthrax vaccine!
I’m guessing that vaccine will have “unintentional” side effects that require the legal immunity HHS has just granted Emergent and the other 21 contractors.
I’ll spell this out for those that haven’t connected the dots:

Never mind … go back to sleep … the shelf life of the vaccine to be produced in Emergent’s latest contract has a shelf life of four years and won’t be completely manufactured until 2011. Never mind that we already have untold millions of doses on the shelf.
“Emergent Biosolutions Inc. has won a contract to provide more anthrax vaccine to the U.S. government worth as much as $404 million.
The order is for 14.5 million doses of Emergent’s Biothrax vaccine which will be added to the Department of Health and Human Services’ Strategic National Stockpile. The order will earn Emergent between $364 million and $404 million depending on how much of the order can be filled with vaccine with a shelf life of four years.”
“The race to develop and supply the government with anthrax-fighting drugs just got more heated. Two rival biotechs — Emergent BioSolutions of Rockville and PharmAthene of Annapolis — announced yesterday that they received separate federal development contracts to build new anthrax vaccines. Emergent is currently the government’s sole supplier of anthrax vaccine under a $448 million contract to stockpile 18.75 million doses of BioThrax. But BioThrax requires six injections over 18 months to produce immunity and inoculated soldiers have reported serious side effects. So the government is looking for better vaccine technology.”
So for anyone who hasn’t paid attention to the history of the to the warnings and threats of bio-terrorism by the Bush Administration, Homeland Security and members of Congress, we can tie this in with a 2001 bio-terrorism simulation code-named Dark Winter.

The scenario is set in three successive National Security Council (NSC) meetings (Segments 1,2 and 3) which take place over a period of 14 days. Former senior government officials played the roles of NSC members responding to the evolving epidemic; representatives from the media were among the observers of these mock NSC meetings and played journalists during the scenario’s press conferences (see Participant List). The exercise itself was held at Andrews Air Force Base, Washington, D.C. on June 22-23, 2001.
The Dark Winter exercise was the collaborative effort of four organizations. John J. Hamre of the Center for Strategic and International Studies (CSIS) initiated and conceived of an exercise wherein senior former officials would respond to a bioterrorist induced national security crisis. Dr. Tara O’Toole and Dr. Tom Inglesby of the Johns Hopkins Center for Civilian Biodefense Strategies and Col. Randy Larsen (USAF, Ret.) and Mark DeMier of Analytic Services Inc. (ANSER Institute for Homeland Security) were the principal designers, authors and controllers of Dark Winter. Sue Reingold of CSIS managed administrative and logistical arrangements. General Dennis Reimer of the Memorial Institute for the Prevention of Terrorism (MIPT) provided funding for Dark Winter.”
